ARTWORK SALE TERMS
Warranty & Disclaimer: Gaya Art Studio warrants that the described artwork is an original creation of the artist and that the artist possesses all legal rights in the work. The artwork is sold as is. Any warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose, are explicitly disclaimed.
Sale, Payment & Delivery: The buyer agrees to buy the artwork as described above and pay the published price, delivery costs and applicable taxes. Sales, payment and delivery terms are defined by PayPal User Agreement.
Copyright & Reproduction: In accordance with the current and consolidated Canadian federal law, Copyright Act (R.S.C., 1985, c. C-42) and respective regulations made under this Act, as well as in adherence to the Bern Convention for the Protection of Literary and Artistic Works, the artist and Gaya Art Studio reserve all reproduction rights, including the right to claim statutory copyright and without limitation all copyrights and trade dress rights, in the artwork. The buyer may reproduce the artwork only upon advance express written permission from the artist in each instance (except for incidental noncommercial reproductions such as personal photographs of physical settings where the Artwork is displayed). The artist’s signature and/or copyright notice as they appear on the artwork at the time of sale shall not be removed or concealed. The artist shall receive authorship credit in connection with the artwork or any reproductions of the artwork.
Maintenance & Repairs: The buyer will not intentionally damage, alter, modify, or change the artwork in any way whatsoever. If any alteration of any kind occurs after receipt by the buyer, whether intentional or accidental and whether done by the buyer or others, the artwork shall no longer be represented to be the work of the artist without the artist’s written consent. The buyer shall undertake reasonable efforts to ensure that the artwork is properly maintained. The buyer shall not destroy the artwork or permit the artwork to be destroyed without
first offering to return ownership to the artist or her successor in interest. The buyer shall seek the artist’s prior written approval for all repairs and restorations to the artwork which are made during the lifetime of the artist. To the extent practical, the artist shall be given the opportunity to accomplish said repairs and restorations at a reasonable fee.
Resale & Retransfer: If the buyer in any way whatsoever sells, gives, or trades the artwork, if it is inherited from the buyer, or if a third party pays compensation for its destruction, the buyer (or the representative of his/her estate) must notify the artist within 30 days. If anyone becomes the new owner of the artwork, that person shall be bound to all its terms.
SHOP POLICIES
Payment Policy: We accept payments via PayPal. Our sales and payment policies follow PayPal user agreement terms. The sales taxes are posted where applicable. We expect to receive your payment within 48 hours.
Delivery Policy: Once cleared payment is received we will process and ship your package. Usual processing time for paintings is 2 business days unless otherwise specified. Your painting will be carefully packed and protected. Paintings are shipped unframed.
Shipping time depends on the selected shipping service provider and differs for domestic and international delivery. We usually ship paintings via Canada Post, FedEx or UPS depending on the destination and other circumstances. Shipment is arranged in the most efficient and economical method possible, and the shipping service provider is responsible for any possible delays from a scheduled delivery date. Please contact us prior to purchase if you need an item shipped more quickly. All sent items are tracked for delivery confirmation. Estimated Delivery Time is 8-11 business days. Please check individual listings for shipping fees when you proceed to checkout. Please note that we DO NOT make a profit from processing and shipping. Shipping fees depend on the selected shipping service provider and differ for domestic and international delivery. International buyers are responsible for any possible customs, taxes and duty fees. Please contact us if you have any other questions on our delivery policies.
Refund Policy: We want you to be 100% satisfied with your experience of buying artwork online. We are ready to hear your feedback and possible concerns with regards to any particular purchase. Please contact us directly within 3 days of receipt of the item. All of my original artwork is insured. In the case of loss, the customer gets a refund as per a filed insurance claim. All sent items are professionally packaged with great care to protect your purchase. If the painting was damaged during shipping or it is delivered to you in unacceptable condition, do not reject delivery and do make sure the damage is documented and noted by the delivery carrier. Please contact us as soon as you receive the shipment and let us know immediately of the damage by emailing us. Notice of damage must be given to us within 48 hours of delivery as shipment carriers have time limits and restrictions in place for filing claims and we will not be able to file a claim and offer you a refund.
Return Policy: Returns will be accepted within 4 days of you receiving the painting. If you are not completely satisfied with your purchase and would like to return it, please contact us immediately and you can return the painting at your expense. Please make sure it is packaged and shipped in the same way that it was received. The item must be in its original condition. Once we receive the item back, we will provide you a full refund, minus our incurred shipping charges.
ABOUT GAYA
Gaya is an award-winning international contemporary abstract artist from Toronto. A recipient of numerous art awards and an author of several art publications, Gaya exhibits in Americas, Europe and Asia. Her abstract paintings are proudly held in a number of private collections.
During her prominent artistic career, Gaya has succeeded in many of her endeavors. Gaya is a Leonardo da Vinci 2023 International Prize Awardee, a Winner of the Great Art UK Runner-Up Award at Lacey Summer Art Prize in London, a Featured Artist with Manhattan Arts International for years and a recipient of Human Rights? #EDU 2018, Call for Chelsea 2017, Biancoscuro Art Contest 2017 and Art Parma 2016 Winner Awards, Artprotagonist 2015 Award and the First Place Winner in CAGO Abstracts. Gaya’s achievements record spans from Collector’s Vision International Art Award Winner 2021, Palm Art Award 2019 and Artmajeur Gold Awards 2015/2014 to being the Finalist of prestigious art competitions Donkey Art Prize, Venezia Open Art and Lacey Contemporary in 2015. Moreover, Gaya’s works have been published in Art Compass 2016 by Himmelblau, Volume IX of International Contemporary Artists. The artist is remarkably featured in Aesthetica Magazine, Contemporary Art Curators Magazine, Vox Groovy and the Women in Art 278.
Gaya actively exhibits in Canada and abroad. Gaya’s works showcase in Italy, Spain, Portugal, Germany, Austria, Switzerland, Netherlands, UK, Japan, Colombia and the United States. Her landmark art book “Stretching the Boundaries of Abstract” was published in 2015. In addition, video art projects of Gaya appear in major art events and festivals. Her abstract art photography remarkably complements the creative concepts of Gaya’s artwork.
